My Money, My Future: Canadian Financial Education Challenge  

OFFICIAL RULES

1) Challenge Period

The My Money, My Future: Canadian Financial Education Challenge (the “Challenge”) begins at 12:00:01 a.m. Eastern Time (“ET”) on October 15, 2021 and ends at 11:59:59 p.m. ET on May 19, 2022 (the “Challenge Period”). By participating in the Challenge, each entrant agrees to abide by and be bound by these Official Rules and all decisions of The Canadian Foundation for Economic Education (the “Sponsor”), which shall be final and binding, without right of appeal, in all matters relating to this Challenge and the awarding of the prize(s), including without limitation eligibility and/or disqualification of submissions.

2) Eligibility

The Challenge is open to legal residents of Canada who are between fourteen (14) years of age and 18 years of age as of the date of submission. Entrants who are below the age of majority in their jurisdiction of residence must have the permission of their parent or legal guardian in order to enter the Challenge.

Excluded from eligibility are the officers, directors, employees, agents and representatives of Sponsor, any Challenge judges, prize suppliers (including without limitation Canadian Imperial Bank of Commerce (“CIBC”)), and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, the "Promotion Entities"), where such individual is directly involved in the creation or administration of the Challenge, and members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such officers, directors, employees, agents and representatives.

3) How to Enter

NO PURCHASE NECESSARY. Internet access and email address required. To enter, visit www.mymoneymyfuturechallenge.ca (the "Challenge Website") during the Challenge Period and correctly fill out the Challenge submission form provided. All fields are mandatory unless marked as optional. Limit: one (1) submission per person and per email address during the Challenge Period. Submissions may be submitted by more than one individual as a team of up to four (4) individuals, in which case one teammate must be identified as the contact individual for submitting the submission. Teachers may facilitate submissions on behalf of their students. 

Consent of Parent or Legal Guardian:  Entrants who have not reached the age of majority in their jurisdiction of residence must provide parent or legal guardian’s name, address, telephone number and email address on the submission form as well as confirm that they have obtained parental consent prior to clicking on the “submit” link.

All submissions must meet the following submissions guidelines (the “Submissions Guidelines”):

  1. The submission must not defame, misrepresent or contain disparaging remarks about Sponsor or any of its products, or other people, products or companies or communicate messages inconsistent with the positive images and/or goodwill associated with the Sponsor, as determined by Sponsor in its sole discretion.

  2. Submission must be suitable for family audiences, including without limitation for publication on national television, as determined by Sponsor in its sole discretion.

  3. Submission must not contain any content that is or contains: unlawful behaviour, profanity, explicit sexuality, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or is hatefully, racially, ethnically or otherwise offensive or objectionable, as determined by Sponsor in its sole discretion.

  4. Submission must not infringe on the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased.

By submitting an submission, you warrant and represent that (including on behalf of your other teammates, if applicable): (i) the submission is your original work, created solely by you, and over which you have all necessary rights, title and interest, including copyright; (ii) the submission has not been previously published; (iii) the submission does not infringe upon the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased; (iv) all individuals appearing in the submission have granted to you permission to publish or otherwise use their likeness in the submission in any manner and media whether now known or hereafter devised including, without limitation, on the Challenge Website; and, (v) that the submission complies with the Submissions Guidelines.  You agree to indemnify and hold harmless Promotion Entities from any claims to the contrary.

By entering, you agree as follows (including on behalf of your other teammates, if applicable): (i) you acknowledge that your submission may be posted by Sponsor on the Challenge Website and/or highlighted on Sponsor or CIBC’s social media channels, in their respective sole discretion but without obligation; (ii) you have the right and authority to, and do hereby, grant to Sponsor and CIBC an irrevocable, non-exclusive, royalty-free worldwide license in perpetuity to reproduce, store, copy, broadcast, display, distribute, edit, alter, combine with other material, publish, post, commercialize and/or otherwise use without limitation all or any part of the submission in any manner or media, including without limitation on the Challenge Website; (iii) you waive any and all moral rights that you may have in and to the submission with respect to the uses contemplated herein; and, (iv) you agree to release and hold harmless Sponsor and CIBC from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relates in any way to Sponsor and/or CIBC’s use of the submission.

4) Prizes

There are three (3) cash prizes available to be won, to be awarded in the form of a cheque, as follows:

  • First Place: $10,000

  • Second Place: $5,000

  • Third Place: $2,500

Prizes must be accepted as awarded and may not be substituted or transferred, except at Sponsor’s sole discretion. Where winning submission consists of more than one individual, Sponsor shall award the prize in equal portions to all individuals identified as part of that submission as of the time of entry. Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Prizes will be delivered to verified winners only to one (1) address in Canada. Sponsor will not replace any lost or stolen prizes. Any other costs or expenses associated with the prizes not specified herein will be the responsibility of selected winners.

5) Winner Selection

Regional Round

The following shall each be defined as a “Region”: British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, Nova Scotia, New Brunswick, Prince Edward Island, Newfoundland & Labrador, Yukon, Nunavut and the Northwest Territories.

By June 1, 2022 the Regional Challenge judges will review all eligible submissions received during the Challenge Period on the basis of the following equally-weighted criteria (the “Criteria”):

P ractical: Is it feasible to implement? It is easy to use? Can it be scaled up to use?

R elevant: Is the topic and content relevant to youth and what youth care about?

O riginal: Is it creative and new – and represents a new way of teaching a topic or skill?

F inancial Content: Is the financial information and content accurate and applicable to youth?

I mpact Potential: Is it going to appeal to youth and engage their interest?

L earning Potential: Is there good potential for youth learning financial knowledge/skills?

E xceptional: Does it stand out? Overall impact it has on the judges?

The submission in each Region that receives the highest score in that Region on the basis of the Criteria will be selected as eligible to progress to the Final Round as a finalist. Additionally, the submission in each Region that receives the second highest score in that Region on the basis of the Criteria will be selected as eligible for the wild card random draw. On or around June 2, 2022, a random draw will be conducted from each Region’s wild card submission for the purposes of selecting one (1) submission that will be eligible to progress to the Final Round as a finalist.

In the event of a tie in a Region for either the first or second highest score, the tie will be broken by selecting the submission with the highest score on the Impact Potential criteria of the Criteria. If a tie still remains, the tie will be broken by conducting a random draw from among all tied submissions in that Region for the purpose of selecting the potential winner. Odds of being selected as a finalist depend on the skill in meeting the Criteria and the number of eligible submissions received during the Challenge Period in the applicable Region. 

Final Round

The fourteen (14) finalist entrants selected following the Regional Round will be notified of their selection in accordance with the below notification process, and invited to attend a virtual event on June 16, 2022 at which they will have the opportunity to provide a 3 minute video about their submission, as well as participate in a live Q&A with judges. Finalists will be given more detailed information on the restrictions and requirements applicable to their Event presentation about their submission, which in general will include a discussion and description of their submission, as well as their response to how they would use the prize to set them on a path to financial wellbeing.

The finalist submissions presented at the Event will be judged in real time at the Event on the basis of the Criteria (90%) and the quality of the presentation (10%) (“Finalist Criteria”). Factors determining the quality of the presentation will be: organization, persuasiveness, communication, creativity and purposes proposed for using the prize. 

The three (3) finalists that receive the highest three (3) scores on the basis of the Finalist Criteria will be selected as the winner (1st place, 2nd place and 3rd place). Odds of being selected as a winner depend on the skill in meeting the Finalist Criteria. In the event of a tie, the entrant who submits the submission that receives the highest score in the Criteria portion of the Finalist Criteria will be selected as the potential winner. If a tie still remains after this first tie break procedure, the tie will be broken by selecting the submission with the highest score on the Impact Potential criteria of the Criteria. If a tie still remains after this second tie break procedure, the tie will be broken by conducting a random draw from among all tied submissions for the purpose of selecting the winner.

6) Selected Entrant Verification and Prize Claim Conditions

Entrants selected as potential Final Round finalists will be notified by telephone or email at the telephone number or email address provided at the time of entry. In order to be declared a winner, selected entrants must: (i) respond to notification of selection within three (3) business days of first attempt by Sponsor; (ii) sign and return to Sponsor, within three (3) business days of it being sent by Sponsor, a written declaration and release form, releasing the Promotion Entities from any liability in connection with this Challenge or the use, misuse, awarding or possession of any prize and granting rights in connection with Sponsor and/or CIBC’s use of the submission (the “Release”); and, (iii) otherwise comply with these Official Rules. In the event that a potential winner is below the age of majority in his or her jurisdiction of residence, Sponsor may require the potential winner’s parent or legal guardian to ratify the potential winner’s Release.

Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within three (3) business days of first attempt by Sponsor or Sponsor’s agent, failure to provide proof of eligibility (if requested), Release, or other required documentation in a timely manner, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited prize in accordance with these Official Rules, who will be subject to disqualification in the same manner.

7) Right to Void / Terminate / Suspend / Modify

Sponsor reserves the right to terminate, suspend or modify this Challenge, in whole or in part, at any time and without notice or obligation if, in Sponsor's sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Challenge, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Challenge, Sponsor may, in its sole discretion and void any suspect submissions and: (a) terminate the Challenge, or any portion thereof; (b) modify or suspend the Challenge, or any portion thereof, to address the impairment and then resume the Challenge, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prizes from among the eligible, non-suspect submissions received up to the time of the impairment in accordance with the winner selection criteria discussed above. 

Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Challenge and/or Challenge Website, violates the Official Rules, or acts with intent to annoy, abuse, threaten or harass any other person.

8) Limitation of Liability and Releases

BY PARTICIPATING IN THIS CHALLENGE, ENTRANTS AGREE THAT SPONSOR, CHALLENGE JUDGES AND THE PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM THE CHALLENGE, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, OR THE MERCHANDISE FOR WHICH IT IS REDEEMED (IF APPLICABLE).  FURTHER, BY PARTICIPATING IN THIS CHALLENGE, ENTRANTS AGREE THAT SPONSOR, CHALLENGE JUDGES AND PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) SUBMISSION OR PARTICIPATION IN THIS CHALLENGE, INCLUDING ACCESS TO AND USE OF THE CHALLENGE WEBSITE, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY.  Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.

Without limiting the foregoing, Sponsor, Challenge judges and the Promotion Entities, and any of Sponsor's other suppliers or contractors, shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Challenge Website users, or by any of the equipment or programming associated with or utilized in the Challenge, or by any technical or human error which may occur in the processing of submissions in the Challenge; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, submissions; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Challenge judges or Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Challenge or in connection with the Challenge Website; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.

9) Protection Of Personal Information and Publicity Release

Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Challenge for the purposes of administering the Challenge and prize fulfillment.  

By accepting a prize, winner agrees to CIBC and Sponsor's use of his/her name, city/province of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity CIBC, Sponsor and each of their respective successors, assigns and licensees may conduct relating to the Challenge in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice, and hereby releases Sponsor and the Promotion Entities from any liability with respect thereto. 10) General Conditions

All submissions become the property of Sponsor and will not be returned and no correspondence will be made with or entered into except with selected entrant(s). Winning a prize is contingent on fulfilling all the requirements set forth herein. Mass submissions, automated submissions, submissions submitted by third parties, and any submissions or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All submissions and prize claims are subject to verification. Proof of entry does not constitute proof of receipt. Entrants agree to abide by these Official Rules. Decisions of Sponsor and/or any independent Challenge judging organization will be final and binding on all matters pertaining to this Challenge. Challenge is subject to all applicable federal, provincial and municipal laws. Void where prohibited. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law. Should a winner make any false statement(s) in any document referenced above, the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof.  WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CHALLENGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of the person who submitted any submission, the authorized account holder of the e-mail address submitted at registration will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
